EXHIBITS
OVERWHELMING, CLEAR, AND
CONVINCING EVIDENCEThese Exhibits were before
the U.S. Middle District Court
in Montgomery, Alabama
when Magistrate Judge Susan Walker
made her recommendation.
Federal Judge Myron Thompson upheld
the recommendations.
It is an ominous sign
of an irretrievably broken system
when the
United States Federal Courts
refuses to protect a citizen's
guaranteed Constitutional Rights!
Who else are they to be guaranteed by???

Transcript of January 24, 2001 hearing where
Beverly Brabham chose to end the (illegal) 'probation revocation'
in confinement, therefore end the sentence on April 10, 2001

Judge Burt Smithart imposed the third of multiple sentences
on the same case, just 8 days after its second expiration.
He was still under the scrutiny of Federal Court on
allegations concerning the second of multiple sentences
when he
imposed third sentence.

Attorney Scott Johnson, through this motion, attempted to
urge the Judge to correct the harmful, now irreversible error

Judge Burt Smithart's letter to the
Alabama Attorney General's Office,
admitting to the sentencing,
after it ended on April 10, 2001

Federal Judge's order, allowing Beverly Brabham
to submit material on the case to expand the record.
The Court order states that Smithart
supplied the evidentiary material

Judge Gaither's Affidavit stating that Beverly Brabham
was not ever placed on probation by the Bullock County
Circuit Court, after the sentence, which had been suspended,
then ended in May 1997, after the terms of the
suspended sentence were met
